iTunes rip off from Zmags Visual

Today I received an e-mail from Zmag, who so very proudly introduced their "brand new and elegant way of presenting an online magazine": The Zmag Visual
Basically it's not new at all and the technology/visual effect is directly stolen from Apples well known cowerflow function used within iTunes! Had this happened in the U.S., someone (perhaps myself) would probably have notified the authorities and filed suit against the company, but luckily for Zmag, we're in Denmark and the rules are not as easily bend here!
Of course I couldn't tell if they actually have the rights and source codes to carry out this "new" magazine branding, but I seriously doubt it!? Please correct me, if I'm wrong.

Your software is rich in characteristics, but what sense would it make if your end-user had to lookup a user manual on 'understanding the interface'? Your software is robust, scalable and the architecture lying beneath it is phenomenal, but what sense does it make if it is not 'user friendly' ?
